Rob , remember in the Pm I sent you about my thoughts on actual stove distance from the floor verses the general .
Well you remember seeing how close my glenwood 6 is from my wood floor . After getting it up to good temperature and putting it base heater mode, I can say the floor doesn't get the heat . And the base heater is where the bottom gets hot! The stove you are talking about putting in will be getting hot around mid level and upwards . I don't think you will have an issue .
There are a lot of houses that don't meet modern code but that doesn't mean you have to change them . Remember they need jobs too and need to keep them so codes and so on will always be changing and not always making sense .

thanks for all the advise, I just had my ds 1600 coal stove installed yesterday. and wow this stove is a monster. I am sure this stove will heat my whole house. will post some pics real soon!

It looks great! Not too much farther from the floor than mine . Have you fired it up yet? You could put down stove board or a piece of hardie board or hardie backer in front if it seems to get too hot until you figure out what you want to do with it next summer . (The Hearth that is )

yes fired stove up last week, amazing stove! works great , nice and warm. the stove board contains Asbestos doesn't it? I will tile around stove after this winter. but I want to put something around hearth in the mean time as the floor does get kinda warm.....

holy *censored* balls that things a beast looks like somebodys going to be toasty warm this winter
I see those fireplace carpets very cheap almost everywhere (not that this is code by any means!) but its an extremely inexpensive way to at least improve your situation without freeking the wife out to much by having sheet of hardy board across her living room
