In 2000, Roman agreed to bequeath the breaker to the Huber Breaker Preservation Society for an anthracite museum and park. The deal was conditional on Roman receiving an adjacent property owned by the Luzerne County Industrial Authority, so he could have a convenient place to move his operations, Santora said.

The deal never went through because Roman didn't get the county-owned land. In addition, Ashley Borough didn't have the money to pay for liability insurance on the property, Clarke said.

Luzerne County commissioners tried to take the property by eminent domain in January 2007, but had to drop it in January 2009 because they didn't have the money.
