Misgendering a person disorderly conduct-jail time stuff?

[3] Bartow suggests in his briefs that his remarks reflect his discomfort with gender labels and sex stereotypes. Opening Br. at 10-11, Reply Br. at 1-2, 5. He maintains that he used the slur because "just like it can be `offensive and degrading' to be called `[n****r],' it `can be degrading, humiliating, invalidating, and mentally devastating' for a transgender person to be misgendered, to be called `sir' when they are not a male or `ma'am' when they are not a female." Reply Br. at 8 (citations omitted).

An interesting footnote in a disorderly conduct case...the court did not reach a conclusion on this point due to other issues noted in the decision.

But one can foresee disorderly conduct (DC) being a charge for "misgendering" someone.

The court put this in their decision as a footnote so clearly trans people are claiming that DO applies.

That's a good one...maybe the charge for misgendering should be breach of peace (a more severe charge than disorderly). He went ape-chitty chitty

What ever happened to Free speech. Its now a crime to offend someone,but not a crime to loot ,riot and burn private property. The patients have taken over the asylum.

Nope. It's only "half" a blow to free speech. Same thing that was done by someone on the left is still free speech. And to further show it was half-justice they waited four years until the Dems were back in power to charge the guy. :roll:

18 USC 251 & 18 USC 252 covers deprivation of rights. Gov't officials are hardly ever arrested let alone convicted of these.

This is the case where the defendants told people to vote on twitter and their vote would be counted ?

If no one actually did then I think that a conviction is not appropriate. I did not follow this case closely.

I think it was more than "making fun of voters" case.
